Terms of use

1. Purpose

Ubino is a contributory mapping service that allows users to associate a piece of information with a place — a "flag" — to attach keywords, a lifespan and a visibility level to it, and then make it available for consultation by other users.

Use of the service constitutes acceptance of these terms.

2. Access to the service

Viewing and creating flags requires no account. An account is only required to subscribe to paid features.

The service is provided free of charge in its essential functions. The publisher guarantees neither permanent availability nor the absence of interruptions, and may suspend the service for maintenance.

3. Status of the publisher

The publisher acts as a hosting provider within the meaning of Article 6 of French Law No. 2004-575 of 21 June 2004 on confidence in the digital economy (LCEN) and of Regulation (EU) 2022/2065 on digital services.

It exercises no generalised prior control over content published by users and is not subject to a general monitoring obligation.

The publisher may nevertheless publish content itself, in particular sets of flags relating to an event. Such content is identified as such and falls under its own responsibility.

4. Responsibility of the publishing user

Each user is solely responsible for the content they publish.

By publishing a flag, a comment or a media item, the user represents and warrants that they:

  • hold all the rights and authorisations necessary for the published content, in particular under copyright, image rights and trademark law;
  • have, where applicable, the authorisation to indicate the place concerned and to encourage access to it, in particular where it is private property or a site with regulated access;
  • comply with applicable legislation as well as the service's content rules;
  • do not infringe the privacy, safety or rights of third parties.

The user indemnifies the publisher against any third-party claim arising from content they have published.

5. Prohibited content

Prohibited content includes, in particular, content that is unlawful, hateful, defamatory or insulting, sexual content involving minors, content glorifying serious acts, content infringing privacy or enabling the location of a person without their consent, as well as content flagging dangerous, access-restricted or sensitive places.

The detailed content rules are set out in a separate document, which forms an integral part of these terms.

6. Licence granted over content

The user retains all of their rights over the content they publish.

They grant the publisher a non-exclusive, free of charge and strictly limited licence for the display, storage and distribution of the content within the scope of the service. This licence ends automatically upon the expiry or deletion of the content. It survives the deletion of the account for content the user has chosen to keep, until its capped expiry.

7. Lifespan and deletion of content

Each flag has an expiry date set by its author at the time of creation.

Upon expiry, the flag and the associated media are permanently and physically deleted. They are neither archived, nor kept in hidden form, nor recoverable.

This deletion is irreversible: it is up to the user to keep a copy of their content if they wish to reuse it.

8. Identification of the author without an account

A user publishing without an account is identified by an anonymous token stored on their device, which allows them to modify or delete their own content.

As this token is local, its loss — reinstallation, change of device, erasure of data — results in the permanent loss of control over the content concerned, which will remain visible until its expiry.

A recovery code is offered to the user to prevent this situation. Keeping it safe is the user's responsibility. The publisher, holding no identifying data, is materially unable to restore lost access.

9. Moderation

The publisher implements two levels of moderation:

  • a limited prior filtering, covering a list of prohibited terms and certain geographical areas identified as sensitive;
  • an after-the-fact processing of reports, in accordance with the procedure described in the dedicated document.

The publisher may remove content that is manifestly unlawful or contrary to the content rules. Any removal decision is the subject of a statement of reasons provided to the author, where the author can be reached.

10. Advertising

The service may display commercial content, clearly identified as such.

Such content is selected based on the keyword searched and the area being viewed at that moment. No user profile is created for advertising purposes.

The display of ads based on an advertising identifier is subject to the prior consent of the user, freely revocable.

11. Paid features

Premium : absence de publicité, services prémium. Tacite reconduction, pas d'engagement. Arret de l'engagement sur l'espace premium de l'utilisateur. Tout mois commencé est facturé en intégralité. Tarif au 15 aôut 2026 : 9€

The consumer has a fourteen-day right of withdrawal. In accordance with Article L. 221-28 of the French Consumer Code (code de la consommation), they may waive this right in order to obtain immediate performance of the service, subject to express agreement and acknowledgement of the loss of the right of withdrawal.

12. Intellectual property

The Ubino trademark, the application, its interface and its components are protected. Any unauthorised reproduction is prohibited.

The map backgrounds come from OpenStreetMap and are used under the terms of the Open Database License (ODbL).

13. Personal data

The processing of data is described in the privacy policy, which forms an integral part of these terms.

14. Amendment of the terms

The publisher may amend these terms. Users are informed of this within the application. Continued use constitutes acceptance.

15. Governing law and disputes

These terms are governed by French law.

In the event of a dispute, the user may have free recourse to a consumer mediator: C2MC.

Failing an amicable resolution, the competent courts are those determined by the ordinary rules of law.
